All types of entities are eligible for the safe harbor, which is a kind of "amnesty" or "voluntary compliance" that limits the look-back period to 10 years for properly prepared reports once all dormant property has been reported.

Generally, penalties are waived and audits are limited to 10 years back.

The safe harbor is not available under the following conditions:

  • Failing to file a report
  • Refusing to allow examination of your books and records
  • An audit has been initiated
  • Fraud
  • Not reporting all dormant property
  • You have been notified that you are under audit prior to reporting
